Apple sues popular Mac Web site

SAN FRANCISCO (Reuters) - Apple Computer has sued
a popular Macintosh rumour Web site for allegedly
distributing trade secrets, the latest in a string of lawsuits
the company has filed to stop Internet leaks of details
of upcoming products.

The latest suit also lends credibility to recent rumours
about a Macintosh computer without a display and an
office productivity software suite that surfaced in the run-up
to Apple's annual trade show held here next week, where
CEO Steve Jobs typically unveils new products.

Apple, in the complaint filed on Tuesday, sued Web site
Think Secret and other unnamed individuals, claiming
that Think Secret had induced these individuals to
breach confidentiality agreements that they had signed
with Apple.

Apple claimed that the information posted on Think
Secret in November and December of this year, and
earlier, could only have been obtained by someone who
had signed a confidentiality agreement with Apple.

"Apple had maintained and protected the Future Product
Information contained in these two articles as trade
secrets, and the information could not have been
acquired by the dePlume Defendants without a
breach of an Apple confidentiality agreement," Apple
said in its lawsuit.

Apple is suing Nick dePlume, who owns and runs
Think Secret, and 20 other unnamed individuals,
some of whom Apple believes gave the unreleased
product information to the Web site. The company
also said that it believes dePlume is an assumed
name, and that it will amend its complaint with
dePlume's real name and the names of the other
defendants, once they were determined.

"Apple's DNA is innovation, and the protection of our
trade secrets is crucial to our success," the Cupertino,
California-based company said in a statement.

Apple also said that its efforts to squelch the publication
of as-yet-unannounced products was not an attempt
to stifle free speech.

"These constitutionally protected freedoms, however,
do not extend to defendants' unlawful practice of
misappropriating and disseminating trade secrets
acquired through the deliberate violation of known
duties of confidentiality," the company said in its
complaint.

Apple said its lawyers had repeatedly sent Think
Secret letters demanding that it withdraw details
of the unannounced products, which Apple said it
did not do, in most cases.

dePlume told Reuters in an email Think Secret was
confident it was within its rights to publish the material.

"We're confident that Think Secret's reporting is
consistent with the right and privileges granted by the
First Amendment," dePlume wrote. "The complaint is
being reviewed, and Think Secret defers further
comment until it has been analyzed."

In recent weeks, Apple already sued three men for
illegally distributing test copies of the next version of its
Mac OS X operating system on a file-sharing Web site
and anonymous people who leaked details about new
products by posting details on the Internet.

This latest lawsuit was filed in California Superior Court
for Santa Clara County and seeks unspecified damages.

Research Changes Lives
 
One of nature's secrets is that it is always expanding
and growing and maturing and then dying. This is our
life, too, and we need to recognize that this is normal
and reliable. We see it in our gardens and our fruit tress,
our schools and our health. We plan for the changes
and we count on them…we anticipate them. As human
beings, we are not meant to be the same all the time - but
for many, a change is horrible. I don't want to discuss
change per se, but I do want to relate it to ideas and
specifically to research. Our health is a very real, personal,
and protected part of us. We believe certain people
when they tell us things. And we build our lives around
our understanding and perception of that viewpoint.

However, because we personally don't "embrace" change,
when we hear something contrary to our belief, we go
slightly mad and accuse others of misleading us. What
I want to bring to your attention with this is that research
by its very nature HAS to produce new ideas (Change)
and thus uncertainty, until it's tested adequately.

So new research findings on things like cancer, arthritis,
cholesterol, or heart disease are all at the "mercy" of
perception: your point of belief and your willingness to
think "outside the box". So if I told you that instead of
taking a cholesterol-lowering drug, you might just need
one mineral product, or that by taking one enzymatic
product, you might be able to have your name removed
from the heart transplant list, would you believe?
(BTW, this is totally doable.) My point is that new research
and new tools and better application of our methodologies,
could easily add years to your life. The question is: do you
want to open your mind to the possibilities that your beliefs
might be challenged.

raised me to be a responsible person. I listened
to you and Daddy and I am the girl you raised. I
am now old enough to live my own life and make my
own decisions. The fact that I now live by higher
law only makes that responsibility mine even more.
You and Daddy are going to have to accept what I
do and trust me. There is no other way. It is not
my intent to hurt you or worry you but all your
worries come from within your own mind. Nothing,
ever, will happen to me. I will always be safe and
I will always be in control of every situation in
which I find myself."

"Sharon, honey, how can you say that? No one
is in complete control of every situation."

"Mrs. Smithson" Tim broke in "you have heard
about me and my family now for many years. You are
aware of how we can control the elements, people,
and things around us. While that is possible for
all people it is only practiced by those who have
committed to living by higher law. Sharon has made
that commitment and is now able to do exactly as
she says. It might be hard for you to believe, yet
it is true. May I ask you to take time with this.
You will soon see that things are all right and
that no harm will come to Sharon. You will also
see that her morals are of a much higher standard
than anyone you know."

"Oh, Tim, I hope you're right. I can't believe
what is happening. What will that do to the
family? What will the neighbors think? What will
the people at Dad's work think?" Harriet was
worrying her head over things that were
unimportant, but human.

"Mom, listen to yourself. Since when does it
matter what the neighbors think. And what are they
going to think about? Are you going over there to
tell them what I'm up to? And what about Daddy at
work? Why should it matter what they think over
there. I don't mean to be silly or uncaring but is
not our business our business. I'll tell you this,
if any harm comes to this family because of what
people think I can handle it without difficulty.
The Henrys do fine. People no longer bother them,
except when they want something. We'll be fine
Mom. You just have to learn that this is the life
I have chosen and will always be."

"Oh, Sharon, how could you do this to us?
Don't you know this will break up the family?
Don't you know how this will affect your Father
and me? Why would you do this to us?"

"Do what to you Mom? What have I done that is
in any way harmful to you or your reputation? How
is it that you are thinking only of yourself? And
how is it that suddenly you are afraid of what
people in Pinehill will think? I know you have
always thought it important that you be seen as
socially acceptable. Now you think you will not as
if your daughter has been found a murderer or
worse. Why is it that your concern over you must
mean I cannot make my own decisions about my own
life and the way I want to lead it?"

"Sharon, I don't mean that. I simply mean that
people will talk. They will point fingers and
laugh. There will be some ladies in my church
group that will no longer speak with me. They will
talk amongst themselves and I will be ostracized."

"You mean that church group still gets
together? I thought after Jesus came to church
that night the church was near to breaking up."

"They came very close. The church women are
working to keep it together. Now this will change
things considerable."

"Mom. Think about what you are doing. Why do
you want to keep together a church that is clearly
giving out the wrong message? What is there that
you want to try to salvage a condition you were
told was wrong?"

"I...I don't know. The ladies seem to feel it
would be wrong not to go to church. They are
afraid that if they or someone in their family
dies they will not have a proper burial, that the
loved one will not go to heaven."

During my training as a medical-group receptionist, I was
told never to recommend one of our doctors over another,
but simply state who had available appointments. One
day a woman came in and looked at me conspiratorially.

"I'm a nurse," she whispered, "and I know the staff always
knows which doctors are good and which aren't. Who
do you think I should see?"

Knowing my supervisor was listening close by, I tried to
sound most professional. "Oh, I'm sorry," I replied. "I
can't recommend any of our doctors."

"Well, you must know!" she said, heading for the door.
