Judge Strikes Maryland Spam Law

A state judge in Maryland recently invalidated the state's
anti-spam law on the grounds that it unreasonably
burdened interstate commerce. In a decision issued
earlier this month, Judge Durke G. Thompson dismissed
a civil lawsuit brought by anti-spam activist Eric Menhart,
against the New York-based company First Choice Internet.
Thompson ruled that the law is invalid because it too
heavily regulates conduct that occurs in other states.
"Defendants had no contact with the state of Maryland
because their e-mails were sent from New York,
routed through Virginia and Colorado, and finally
were received in Washington, D.C.," wrote Thompson
in his decision dismissing the case before trial.
He added that even if a recipient opened the e-mail
in Maryland, that fact alone wasn't enough to make
First Choice and its president, Joseph Frevola, face
a lawsuit in the state. Additionally, Thompson ruled
that the portion of the law banning e-mails that
contain a "false or misleading subject line" is too
vague to be enforced.
Menhart, a 25-year-old third-year law student at
George Washington Law School, said he plans
to ask Thompson to reconsider the case, and if that
is unsuccessful, will appeal to a higher court.
The ruling is believed to be the first of its kind in
Maryland, but appellate courts in both Washington
and California have gone the other way, holding
that those states' anti-spam laws do not unduly
restrict commerce between states.
In the case, Menhart argued that First Choice violated
Maryland's anti-spam law by sending MaryCLE-- a
consumer protection firm Menhart founded--around
two unsolicited e-mails a day between Sept. 18 and
Oct. 29 of 2003. Some of the e-mails also contained
allegedly misleading subject lines, said Menhart.
He attempted to contact the sender about 80 times
by e-mail, and also sent letters by U.S. postal mail
to Frevola, but never clicked on the unsubscribe
link in the e-mails to opt-out of receiving them.
Andrew Dansicker, who represented First Choice,
said the e-mails complied with the federal Can Spam
law because they had a valid opt-out link. Dansicker,
a partner in Baltimore's Schulman Treem, also denied
that the subject lines contained fraudulent statements.
Patchwork of Laws
Whether the approximately three dozen states with
anti-spam laws can enforce them is of great interest
to e-mail marketers because many send messages
throughout the country. Marketers generally maintain
that it's unrealistic to expect them to comply with so
many different state laws, on top of the federal
Can Spam act.
Marketers also say that, with laptops and portable
devices, it's impossible to know where e-mails will
ultimately be opened. First Choice made similar
arguments to Thompson, writing in court papers:
"Plaintiffs' argument that defendants should have
determined which emails were being sent to Maryland
residents located in Maryland is absurd and would
create such an overwhelming burden on any company
as to prevent them from sending out any emails."
For those reasons, some industry experts say that
e-mail cries out for uniform laws. "The Internet, almost
by definition, is a multi-jurisdictional, if not jurisdictionless,
medium," said Trevor Hughes, executive director of
the Email Service Provider Coalition. "You would
hope regulation migrates to the highest level of
jurisdiction possible."
But some consumer advocates say that individual state
laws against fraud are still necessary. While Can Spam
itself supersedes many provisions of state laws, it does
not preempt state laws regulating fraud. "Can Spam
is a floor, not a ceiling," said Chris Hoofnagle, associate
director of the Electronic Privacy Information Center.
"They got this one wrong," said Hoofnagle of the
Maryland court's decision. Hoofnagle was retained
in the case as an expert witness against First Choice.
As of now, the hodgepodge of court decisions across
the country has some observers saying that marketers
won't know for sure whether they must follow a
patchwork of state laws unless the U.S. Supreme Court
gets involved. "This is an issue that could be decided
differently in different states, but ultimately would have
to be decided by the Supreme Court," said Jerry Spiegel,
a partner at the New York law firm

So signs and symptoms, and other acquired skills, are what
doctors base their diagnosis on. Their critical thinking skills
will connect the different body systems for possible causes.
But this process takes time and a willingness of the doctor
to maybe think differently. And here is where a strange
phenomenon is happening. People are bypassing doctors'
offices and going directly to the Internet. The Internet is
a mine of information! When you type in a couple of key
phrases of signs and symptoms, your search will bring up
a huge number of resources! Information from many
different sources . . . some trustworthy and some not as
trustworthy. And this presents you with a dilemma. Now you
aren't sure what to believe and how it would apply to YOUR
body . . . so you want to take all this to your doctor.
DON'T DO THIS! They will most likely not see this the
same way you do. You are doing this to help them with
a diagnosis. And they may well view it as practicing
medicine or interfering or not trusting them to know what's
best for you. Just as you see yourself as an expert in
your profession, they, too view themselves as knowing
all about your body and what's best for you.

"Good for you. Are you going to lead a trading
trip just like your Dad when you grow up?"
"You bet Grandpa, only I'm going to do it
better." He stood tall and stuck out his chest
making like he was a big man.
"Come here you little rascal." His Dad grabbed
for him and missed. The chase was on. Little Sammy
was remarkably fast and he had obviously done this
before. Mazunta caught up to him in about three
strides but little Sammy was able to dart to and
fro unlike his Dad. It was a while before Maz
caught up to him and then only because Sammy was
laughing and taunting.
"You little rascal. I've got you now. I think
I'm going to put you over my knee and let you have
a few, teasing me like that in front of your
Grandpa."
Sam laughed too. "That's it Sammy. You give
your Dad a hard time. I'll bet he did the same for
your other Grandpa."
They all laughed.
Sitting camp fire style for such a long time
was not a position Sam was used to. He was cutting
off the circulation to his legs and they were
developing the "pins and needles" feeling. He
shifted around and put his legs out straight. He
could feel the blood rushing into them
immediately.
AliAnne came over and sat on her Grandpa's
lap. She and Sam talked about the things of the
day. Like all children in loving families she was
trusting to the limit, as she snuggled into her
Grandpa's chest and rested a little. These
children were being raised with a good sound
knowledge of themselves. They were both very
confident in themselves for such an early age.
That was part of the growing process in this
village. The kids didn't seem to tease and taunt
like kids did elsewhere. They, instead, encouraged
one another and helped one another. It seemed to
come from the long standing practice of letting
the very young into the ball game. The result was
that all the kids in the village had a very
healthy self respect and confidence. It wasn't an
obnoxious self confidence that swaggered and
boasted. It was a quiet kind that simply allowed a
child to be strong in all situations. Sam saw this
in AliAnne and was now seeing it develop in Sammy.
Supper was ready and the ladies served it up.
It was Mazunta's favorite fish served with warmed,
not hot, veggies from the forest surrounding the
village. It was a delicious meal. No wonder it was
Maz's favorite.
The gals joined the family and all sat down
together for the meal. The conversation was of the
days events and the children were treated as
equals. Their topics were treated as seriously as
those the adults brought up. It made for a warm,
inviting togetherness where no one was playing the
game of "one-upsmanship". Sam and Alewka always
enjoyed meals here. The "ambience" was wonderful.
Following supper the ladies cleaned up and
they all prepared to go to the nights fire. There
were already people gathering although the fire
was not yet lit. Preparations were happening. it
would be maybe another hour before they would
leave to join the folks at the fire.
Mazunta's folks, Honero and Aniata, joined the
family fire. There was much hugging going on as
they welcomed Sam and Alewka. They all sat down
and continued the conversation. Mazunta's folks
were roughly the same age as Sam and Alewka.
However, living in this locale they showed none of
the signs of stress or worry that usually
accompanied life in North America. They were
relaxed and jovial, laughing at the simplest
things. They were dark of skin after living all
their lives here and they were clearly comfortable
with one another and with the world.
Sam marveled at the difference in the facial
features of the people in this village as compared
to those he knew in Pinehill. These people
certainly lived a relaxed lifestyle far from fear
and worry that marked life in Pinehill or anywhere
else in the States. One becomes so used to ones
environment they cannot really see the conditions.
It is only when you travel to other areas that you
see what is happening at home. Sam was not the
first one to have noticed that observation.
So the three families chatted away the time.
Before they knew it the time to leave for the fire
had come. Their alone time together was far too
short. They all agreed to spend the day together
tomorrow.

furrier. "Show the lady your finest mink!" the fellow exclaims.
So the owner of the shopgoes in back and comes out with
an absolutely gorgeous full-length coat. As the lady tries
it on, the furrier goes up to the guy and discreetly whispers,
"Ah, sir, that particular fur goes for $65,000."
"No problem! I'll write you a check!"
"Very good, sir." says the shop owner. "Today is Saturday.
You may come by on Monday to pick it up, after the
check has cleared."
So the man and the woman leave.
On Monday, the fellow returns. The store owner is
outraged: "How dare you show your face in here?!
There wasn't a single penny in your checking account!!"
"I just had to come by," grinned the guy, "to thank you
for the most wonderful weekend of my life!"
