Microsoft may face daily EU fine
The European Commission has threatened to fine Microsoft up
to 2m euros (£1.36m; $2.4m) a day until it gives rivals more
access to its systems.
Brussels said the software giant had failed to supply
adequate information about its server programs.
Microsoft has five weeks to provide improved documentation
before the daily penalties are imposed.
But the group pledged to contest the EU's "unjustified"
demands by whatever means possible.
'Changing demands'
"We will contest today's statement to the full extent
permitted under EU law, including a full oral hearing on
these issues," Microsoft legal chief Brad Smith said in a
statement.
He added that the firm had done its utmost to comply with
the EU's demands, but Brussels kept changing the goalposts.
"We've shipped a new version of Windows, we've paid a
historic fine, and we've provided unprecedented access to
Microsoft technology to promote interoperability with other
industry players," Mr Smith added.
"In total, we have now responded to more than 100 requests
from the Commission."
In a landmark ruling in March 2004, the world's biggest
software firm was found guilty of abusing its position, hit
with a record fine and told to open up its operating
systems.
Data demand
Microsoft was also ordered "to disclose complete and
accurate interface documentation which would allow
non-Microsoft work group servers to achieve full
interoperability with Windows PCs and servers".
The EU's second highest court - the Court of First Instance
- later rejected an appeal by Microsoft and warned it to
comply with the order by 15 December 2005, or face a daily
fine.
But following two reports from a monitoring trust that has
been checking information supplied by Microsoft, the
European Commission says the software giant has failed to
provide all the necessary detail.
It quoted the reports as saying the technical documentation
was "totally unfit at this stage for its intended purpose".
Appeal plea
In September this year, Microsoft launched a second appeal
against the March 2004 ruling - which included a 497m euro
fine - in an effort to avoid giving more information on its
server programs.
The firm argues that doing so would violate intellectual
property rights.
"I have given Microsoft every opportunity to comply with its
obligations," EU Competition Commissioner Neelie Kroes said
in a statement as the five-week deadline was issued.
"However, I have been left with no alternative other than to
proceed via the formal route to ensure Microsoft's
compliance."
The EU also warned that if Microsoft failed to provide the
necessary information by 25 January, the daily fines would
be backdated to 15 December 2005.

Let me give you another example that is a twist to "cause and
effect" and decision-making or choices. A few days ago, I
listened to a talk show. A caller asked how he could prevent his
two daughters from becoming the "door mat' his wife was. He
didn't want that future for them. He told us that he and his
wife had made a decision to share all the household tasks. Both
worked and she felt overwhelmed with the load of
responsibilities she had for the family and her job. I applauded
silently as this husband shared this beautiful scenario of how
they would share this workload. But here is the twist...he then
added that if he felt he didn't want to do continue this longer
than the three-month trial, he would stop! Cause and effect! I
wonder if his wife had some negotiating power AND boundaries.
Some decisions are made silently without any thought for who
else can be affected. Hopefully this one would be negotiated.
The more additional experiences you have, the more they shape
your personal choices. It's those experiences that help you to
grow and upgrade. As you grow, your horizon broadens. And your
confidence grows. And your body learns that life isn't scary or
to be feared. Isn't it a whole lot better to realise that the
goal posts are always changing and so are you...with positive
anticipation than to accept fear and defeat? Acknowledge that
the long-term effects of this kind of conflict cause
hypertension and other health problems. So when you start to
build in some powerful de-stressors or protectors, it's worth
going through some of the short-term stress. Welcome your
experiences, but be discerning in what you commit to. If you
really want to do it, have your rules (boundaries) ready and use
them. Understand that every action has a built-in cause and
effect. And know that whatever decisions you make, are
"sanctioned" by you: not someone else. Welcome each "growth
opportunity": it will build up your confidence. Learn to let the
negatives roll off your back like the ducks do with water. At
some point you will suddenly like and welcome any tasks because
you know you can do anything!

To Hank this was like a dream. All these things were
happening to him and he had no control. It was as if he were
in a dream watching himself. Yet it was real. He could smell
the air, feel the cold, hardly walk on the slippery snow.
What was happening. He remembered the most incredible peace,
warmth and brilliant light he had just left. He wanted to go
back.
"No Hank, your time will come. It just isn't this
moment. You will remember this time and use it for good for
you and for others during the rest of your time here in
earth."
While, to Hank this was a dream, to Kathy it was a
nightmare. She inadvertently stumbled upon the news while
channel surfing. It spoke of the terrible accident in which
a car had plunged 150 feet down into this canyon. She knew
it was the route Hank used to get home at nights and she
knew the roads were hardly passable.
She wanted to put on her coat and go see. She wanted to
be there in case it was Hank. She had no way of knowing.
Maybe he would drive up soon and walk in the door all safe
and sound. But maybe that was him. Or maybe he had stopped
to look, along with everyone else. Where was he? What could
she do?
The kids were in bed. Kathy was making plans to have her
folks over so she could get out of the house. She was just
about to put her hand on the telephone when something
happened.
Someone spoke to her. She looked around and couldn't see
anyone. There it was again.
"No, Kathy, you will not see me. I am sending you
thoughts, into your mind. I am with Hank. He is fine. It was
his car that went over the embankment. He was pretty shook
up but he is now fine and will need no medical attention."
Kathy didn't know whether to be frightened or thankful.
"Who are you? How is it that I am getting these thoughts?"
The thoughts came again. "It is not important who I am
Kathy. Go inside with your Maker and be thankful Hank is
fine. It will be a while before he is finished with
authorities but he will be home, safe. If you continue to
watch television you will see him when he gets back
up to the road and begins to speak with police. I will cause
the television cameras to find him. You will see he is all
right."
The voice spoke with authority and knowledge. Kathy was
certain it was the right information. She sank to her knees
crying. Here she had been so terrified it was Hank who was
in trouble and yet somehow, now, she knew all was well. As
she sobbed she got up and went back to watch the television.
Quite suddenly Hank was now about three feet from the
road, standing in a bush, yet out of sight, on the opposite
side of the ravine where everyone was trying to reach him.
He saw the rescuers climbing back up. He heard them say to
the fireman in charge, "We couldn't get to the car. It fell
even further down into the gully. Someone from down there
hollered to us that he was all right. He said there was no
one else in the car and that he would come up another way by
himself."
Hank felt a push on his back. He knew it was time. Then
he heard these words. "Hank, it is because of your Maker you
are alive now. You have been given a very special
opportunity. Go speak with the authorities. They will take
you home. I have already informed Kathy. She knows you are
all right. She will be watching you on TV. I will come to
your home and visit you and Kathy at 10 o'clock tomorrow
evening after the kids are in bed and when you are alone. I
will appear in your living room. Be safe Hank and now you
must go."
Hank felt another push on his back and he stumbled in
the wet snow as he tried to make his way onto the road. He
was grabbing trees and finally the guard rail. Then he heard
shouts. "Look, there he is!"
The crowd made it's way to him as quickly as they could.
All were slipping and sliding in the snow. It was a fireman
who reached him first. The fireman grabbed his arm just as
he was slipping backward. Keeping his footing was near
impossible. He was thankful for the hand.
"Come on fella. I've got you now. You're safe."
The thoughts were going through Hank's mind. "You think
you've got me. You don't know the half of it."
They grabbed Hank and literally hauled him up off the
embankment. They had a stretcher there in case Hank was
injured. It was apparent he was all right.
"How are you? How did you manage to get up out of there?
How did you get out of the car? Are you all right?"
Hank couldn't answer all the questions that were being
fired at him. Not only were they coming from firemen and
policemen but a television station had both a camera and a
microphone in his face. Intuitively Hank knew he had to let
this happen. He knew Kathy, at home, needed to see him.
Finally the police took him and put him in a car. There
they questioned him about the accident. They wanted to be
assured he had been alone in the car. Hank told them he was.
He had to give them his address and the address of the place
where he worked. They wanted to check there to see there was
no one else in the car and confirm who he was.
Slowly it became apparent to the authorities Hank was
alone, that this was a freak accident caused by this unusual
storm and that Hank's being here was a miracle. No one knew
how he could have survived a crash like that and all were
wondering how he made it to the top of the embankment.
"I wonder if I will ever see that man again?" were the
thoughts going through Hank's mind.

"Boudreaux Plays a Mean Joke"
One time Boudreaux went ta town and got him a fancy shock
collar so he could train hims new dog. Dat smart alecky ting
come wit a remote. Alls Boudreaux had to do was push a
button and dat collar would "shock" dat dog and teach it a
lesson if'n it was doin wrong.
Well, Boudreaux wuz 'bout to learn him dog someting when Ole
Pierre drapped by and started askin a bunch of questions
'bout it, worrying Boudreaux so much dat he decided to play
a trick on his ole friend.
"Why, dis is a new fangled telephone, Pierre," Boudreaux
tole him. "If'n you put this collar on your neck and walk
out yonder a piece I'll show you how we can talk to each
udder."
Poor Pierre put dat collar on and walked out ina yard a good
ways and turned around 'bout de time Boudreaux done hit the
juice button.
"Whoa! Boudreaux!" Pierre hollered. "Don't say nutin' else.
Dis ting's got a short in it."
