Shakespeare coined the phrase (as he coined many, many words
and phrases). The phrase, found in "The Tempest," refers to
a radical or profound change or transformation in the nature
of something, much like something submerged under water for
a long period is radically changed.
Is it true that a person cannot be tried for the same crime
twice?
The "double jeopardy" principle does indeed stipulate that a
person cannot be prosecuted twice for the same offense.
However, there are exceptions. It does NOT apply when the
action is an offense against both state and federal laws.
The "dual sovereignty" doctrine permits both federal and
state sovereignties to punish the same person for the same
offense if its separate laws were broken. Some states do not
allow prosecution of a person if the federal government has
already done so, and the federal government's policy is to
not prosecute a person if the state has already done so. But
they are not REQUIRED to not prosecute and may do so. A
person can also be tried again when his case ends in a hung
jury (jury cannot reach a verdict) or mistrial.

Adobe Speaks Out on Microsoft PDF Battle
Adobe has issued a statement of response to recent reports
that it has been unable to agree on licensing conditions
with Microsoft regarding the inclusion of PDF support in a
future version of Office.
The company says Microsoft has been an important partner to
Adobe, adding: “Adobe is one of the largest commercial
developers of Windows software, and we share millions of
customers around the world.”
The statement continues: “While we typically do not publicly
discuss our negotiations with customers, partners or
competitors, Microsoft recently made a decision to share
with press the fact that talks with Adobe were ongoing.
Therefore, we feel it is important to provide additional
background and clarification on a few of the resulting
issues that have been raised in the coverage.”
The company confirms it has been in discussions with
Microsoft for “some time,” sharing concerns regarding
features and functionality in the upcoming releases of Vista
(the next version of Microsoft’s operating system) and
Microsoft Office.
“While much of the press coverage to date has centered on
disputes over PDF and XPS [a competitive technology to PDF]
in MS Office and Vista, the real issue is the protection of
open standards,” Adobe explains.
Adobe is committed to open standards, the company continues.
“Adobe publishes the complete PDF specification and makes it
available for free, without restrictions, without royalties,
to anyone who cares to use it. Because we license the PDF
specification so openly, it has become a de facto standard,
used by hundreds of independent software vendors worldwide.
No other specification is employed on as many hardware
platforms, operating systems and applications as PDF. PDF is
incorporated into a number of ISO standards, and Adobe
encourages developers, independent software vendors and
publishers to support and embrace it. While the
specification is available publicly, customers expect Adobe
to ensure that the format does not become fragmented and
that competing implementations of PDF do not undermine what
customers have come to expect in terms of reliable viewing
and printing of PDF documents across platforms and
browsers.”
Adobe then explains that Microsoft in the past has
demonstrated a practice of using its monopoly power to
undermine cross-platform technologies and constrain
innovation that threatens its monopolies.
“Microsoft’s approach has been to “embrace and extend”
standards that do not come from Microsoft,” Adobe warns.
Adobe’s concern is that Microsoft will fragment and possibly
degrade existing and established standards, including PDF,
while using its monopoly power to introduce
Microsoft-controlled alternatives, such as XPS. The
long-term impact of this kind of behavior is that consumers
are ultimately left with fewer choices.
Adobe has made no determination to take legal action against
Microsoft. Any speculation on this matter is just that,
according to the company.
“Adobe welcomes innovation and competition. We are confident
in our ability to drive innovation and compete successfully
given a level playing field. In our discussions with
Microsoft, our motivation has been to maintain a fair,
competitive landscape in the software industry. Any
suggestions to the contrary are unfounded,” the company
states.

A Few Basic Essentials To Keep In Mind
PART 2 of 12
First of all you need to figure out why you would even
want to do this. Cleaning is something we do to keep
our personal environment comfortable, safe, and
enjoyable. For years we used only soap and water. But
as microorganisms became more resistant, we found that
this combination didn’t always take away all the
harmful things around us. We learned that some “dirt”
might cause us health problems. So we started to use
processes that were stronger and killed what we
perceived to be germs. There are many products created
to help with this. They are classified into three main
groups, and many have sub-groups.
Let’s work with your home environment, but know that
these categories also exist for health care sector, and
probably in many other fields. That area of expertise
is called infection control. It is a specialty of
itself. The three broad classifications include
cleaning, disinfection, and sterilization practices.
One important fact to remember is that you cannot
disinfect or sterilize anything that has not been
cleaned (properly). The organic matter (protein) will
prevent the disinfectant to work as designed. Lastly,
whereas disinfectants kill disease causing
microorganisms, sterilization kills all microorganisms:
good and bad.

Things today are SNAFU. (Situation Normal - All F . . . .
Up) That means death and destruction in hot spots all over
the world, Sri Lanka, Irag, Afghanistan. Thailand, Somalia,
Israel, Palestine and other spots.
Then there are those who are suing one another, hoping to
make some money mostly on the back of others. Creative
Technologies is suing Apple, claiming patent infringement,
and a group is seeking class action status to sue Kentucky
Fried Chicken over using trans-fats in their deep frying
process.
All of this is based on the interesting phenomenon man has
for wanting to gain by taking from another. Many do not
realize the universe is limitless, our Makers laws and
supply are limitless and that all we have to do is to pick
up the diamonds we are standing on. We don't need to get
rich by taking from someone else. Get rich by going out and
doing something unique, different, create.
Most of you realize I use a Mac computer and am a fan of
Apple. One of the reasons is that Apple isn't a copier and
doesn't use things that belong to others. Apple is an
innovator and comes up with new things, different things.
Today folks all over the world are trying to shut Apple down
saying its proprietary software (required by the music
labels and musicians whose music they sell) is too
restrictive, that Apple should open up its iTunes or more
specifically its DRM (Digital Rights Management software
that restricts where and how the music and video downloaded
from iTunes, is used) so all companies products can play
their music. This stand makes me sick. If it weren't for
Apple there would be no portable MP3 players, there would be
no market. If you don't like that then go your own way.
Apple is entitled to the fruits of its labors just like you
and I are.
The world seems bent on protecting the trade secrets of the
drug companies so they can make billions on their protected
formulas, yet they do not afford Apple the same rights and
privileges? Give me a break folks.
Elsewhere I see science has finally come up with a bird flu
vaccination that appears to be working. Further tests are
needed, of course, but it looks like they are well on the
road.
Science also now thinks caffeine can cause man to be able to
handle significantly more radiation AND, finally, there is a
radically less incidence of cancer and cardiovascular
diseases in Indonesia and South China where people usually
smoke heavier and where pollution is greater. While science
does not know exactly why this condition prevails they are
looking more and more to green tea as being the answer.
Green Tea is emerging as Mother Nature's miracle drink.
