Judge dismisses spam conviction
Wednesday, March 2, 2005

LEESBURG, Virginia (AP) -- A judge dismissed a felony
spamming conviction that had been called one of the
first of its kind, saying he found no "rational basis" for
the verdict and wondering if jurors were confused by
technical evidence.

Ruling Tuesday, Judge Thomas D. Horne also said
jurors may have gotten "lost" when navigating Virginia's
new anti-spam law in the case of Jessica DeGroot.
But Horne upheld the conviction of her brother, Jeremy
Jaynes, who prosecutors said led the operation from
his Raleigh, North Carolina, area home.

DeGroot, 28, and Jaynes, 30, were each convicted in
November for using false Internet addresses to send
mass e-mail ads through an AOL server in Loudoun.
The jury recommended that Jaynes spend nine years
in prison and that DeGroot pay $7,500 in fines.

Prosecutors had called the felony convictions the
nation's first for spamming.

They said the siblings and a third defendant, Richard
Rutkowski, sent more than 10,000 spam e-mails over
three days in July 2003. Rutkowski was acquitted.

Jaynes' attorney, David A. Oblon, had argued that the
spamming was not conducted in Virginia and that there
was no evidence that e-mails were unsolicited. Oblon
said he would appeal.

Bones: Don’t Take Your Support
System For Granted

There are some times, when you need to have more
involved “restoration” treatment done. For instance a
broken hip, which really means the femur or long bone
in the leg, is broken or actually the tip (head) of it
has broken right off. In this case the surgeon would
either put in a “plate and screws” or remove the head
of the femur. They would then insert a strange looking
metal hip “prosthesis” into this hollow shaft. This
artificial hip would then fit snugly into the hip joint
(the iliac crest). The area’s muscles will keep it in
place. That will allow the person to walk again. Once
you have restored the proper alignment to any damaged
bone, it’s time to feed the body so it can heal as
quickly as possible. If you have read this column for a
while you will know that optimum nutrition, lots of
water, and rest will go a long way to healing the
damage.

Eventually, some sort of therapy to help mobilize the
inactive bone will have to be done. That could be with
a therapist or your own efforts. This will have to be
done under the direct supervision of a health care
professional. If you do this too quickly, you can
re-injure the area. If you take too long, healing might
be set in before alignment is in place. Be careful in
the use of heat and cold therapy. You need to know how
to use them properly: the misuse of either could do
more harm.

But what about areas you can’t see to reach them as
easily as a leg bone? The bones in your middle ear? Or
the skull? Or the labyrinth of your inner your ear?
Bone shows up on all sorts of diagnostic tests such as
x-rays, or MRI and CAT scan. “Healing” as new bone
growth shows up as well. Many times if the damage is
not too severe or the bone pieces are not out of
alignment, doctors will choose not to do more than
immobilize the area. They would let “nature takes its
course”. They would rely on your body’s natural ability
and tendency to heal itself. If you have ever had a
fractured rib, many times the area isn’t even strapped.
The reliance is on the body’s natural anatomy (negative
pressures) and healing powers.

and leads to the only way they could survive.
The story leads to many friends, many
adventures and many places.

Jill looked into Eloise's eyes and again
mouthed the words "Thank you."

All three sat there for another five minutes,
chatting, then getting out of the booth, said
their good byes. Jill was on her way, when she
stopped. Turning around she came back to Eloise
and gave her a big hug, then left.

Eloise looked at Alewka, "Find anything you
want to buy?"

Alewka laughed. "Don't be silly. I was just
snooping around, giving you two some time
together. I am glad I did. It looks like it was
needed."

"Oh, Mom. Jill's parents put her down all her
life. She was never shown her efforts were
appreciated. If she didn't get it right the first
time they called her stupid. It happened for so
many years the poor girl knew nothing else. She is
free now to become the woman she wants. She knows
that. What time is it? Is it time we were getting
home?"

"Oh, we have some time left. There is no
reason to rush about. Besides the men have all
gone out to the lake cottage, remember?"

"Yes, but even that will take us some time if
you want to drive. But I guess the guys can fix
their own supper. I have already spent so much
time being the one that does the meal thing and
look after the kids I feel guilty when I'm not
there doing that."

"I know, and it gets worse as the years go on.
It is all part of living together. After the kids
grow up you will be somewhat more free. I found
that with your Dad, he willingly looks after
himself, and even me if I am feeling lazy. Since
living by higher law gives him the ability to do
things he willingly does them. I think Maz is the
same."

"Oh, he is Mom. I couldn't ask for a better
husband. It is just that 24/7 thing because the
kids are young. I know, too, that when the kids
master higher law my whole life will change, so
these habits will not be for the rest of my life."

"Come, there is another store I want to show
you."

With that the two ladies walked out into the
street and made their way to the cities newest
furniture store. Again, it was one of the
buildings destroyed in the explosion and so had to
be rebuilt. It was made to look like the old one
on the outside, but the inside was altogether new.
It had two mezzanines, a main floor and a
basement. All the stairways were wide enough so
five people could walk abreast. It made the store
look spacious and inviting.

A salesperson came up to them, "May I help you
ladies? Looking for some furniture? El ...
Eloise?"

Eloise smiled. "Hi Brock. Yes it's me, Eloise
Henry. How are you?"

"Eloise Henry, I haven't seen or heard of you
for years. How are you. My, where did you get that
tan. That'll make every girl in town envious."

"Thanks but enough of the flattery. I live in
South America with my two children and my husband.
How are you doing?"

Alewka knew there would be some chatting going
on here for a bit so she excused herself and went
to look around the store.

"My God, Eloise, you are a very pretty woman.
Of course you always were, but that tan makes you
look like you just stepped out of a modeling
magazine."

"Brock, that's enough. Thank you, but that's
enough. Are you married, kids?"

"Yes, I married Mary Hamilton. We bought a
house in the south part of town. We have three
kids, one in school, a four year old and a two
year old. Mary doesn't work. She's a stay at home
Mom, and loving it. I was thinking about you a
couple years back. When this place exploded and
caught fire I was in the basement, along with a
lot of other folk. The store above us was burning
and the floor was on fire. Young Billy Hendricks
came and got us all out. It was a miracle. I know
he lives with your folks. It made me think about
you and that crazy journey you took. That took
some guts, El. You were a brave woman."

"Brock, it scared me half to death. I didn't
know what I was getting into, where I was going,
or when and how I'd get back. I was just a young
woman then. I think the bravery you speak of was
most likely ignorance." Eloise laughed at the
truth of her statement.

Brock laughed too. "Well, it is good to see
you. I'll tell Mary we met. Hey! would you like to
come over for a visit? I'm sure Mary would like to
see you and we could all get caught up?"

"That would be nice Brock. I'll work it out
somehow and I'll drop over one day. Let Mary know
so she will expect me. I haven't seen her for a
long while either. Tell her not to prepare
anything because I have no idea at this moment
when I'll be able to make it. I'll give you lots
of notice. Thank you."

While it may not replicate your story, neither may it be replicated
by you, it does keep you updated on some of the trials and
tribulations of doing business on the internet.

We thought we would keep it up.

TODAY'S REPORT:

Well! What a way to announce I'm ready for a vacation. I'll
bet you had to do a double take on the title of yesterday's
article. The subject matter was on clear thinking and there
is exactly where I make a mistake of considerable
proportions. Oh well! Some things that are done cannot
be undone.

That is why the proofing process for the book. I went
over it twice, my wife went over it twice and with far
more patience and determination than I did, and the
publisher went over it twice, again with determination.
Yet, I'll bet we will still find mistakes when it is published.

his doctor, and is immediately rushed to the hospital, to undergo a

My Friend wakes up after the tests in a private room at the hospital,
and the phone by his bed rings.

we've found you have an extremely nasty virus, which is extremely
contagious!"

"Oh my gosh," cries my friend, "What are you going to do, doctor?"

"Well we're going to put you on a diet of pizzas, pancakes, and pita
bread."

"Will that cure me?" asks my friend.

The doctor replies, "Well no, but ... it's the only food we can get
under the door."
